    Almost all companies, in every field (engg, medicine, nursing, research..) hire people through contracting agencies. Most of the companies these days hire only US citizens or GC or EAD and try best not to hire H1b and if you look at their employees, it is rare to find 50% or more h1b holders.

    On the contrary, outsourcing companies may have majority of their workers coming here on L1 or H1b and when such a fgee is imposed, I guess, for the biggies, it is just a small adjustment in their costs of bringing workers which they will adjust in their other expenses.

    Overall, I am not sure, how much revenue such a law will generate. Will it generate enough revenue which is being claimed (600 million?)

    To me, this kinda speech and trashing Indian companies and outsourcing etc... and showing that they acted on it just looks like it is pure politics to save face during the election year.

    I congratulate everyone whoes PD becomes current beginning of next month. But be aware that all of this is no good until USCIS acts on it. USCIS has to match and increase their pace of processing I-140 & I-485s for people to benefit of this movement. There are thousands of people whose PD have been current since April of this year and still they see no movement on their cases. PD becoming current is just the first & crucial step in this long process, but now it all depends on how well USCIS responds by processing cases in FIFO manner.

    it does say that H1B ext beyond 6 years can not be granted if there is not underlying pending process for GC (LC, 140 or 485).

    However it does not talk about 'what happens if an ext is already granted'? so it still remains gray area. did I understand correctly?

    If extension has already been granted, it remains valid until it's expired, revoked by USCIS, revoked by employer or employer goes out of business. However, H1B status is technically lost (similary to the situation when h1b holder leaves the petitioner but petitioner never revokes h1). Even if USCIS does not revoke the extension, it will be investigated during new I-485 processing/H1 transfer or extension.

    they dont want any 485s coming in because they worked on a Sunday which (like this VB fiasco) is unprecedented..and they want to take OFF until Oct now.....

    What happens to people on EAD and AP...what would happen to thier status...This law does not make sense..I think it may be for people who have not filed for I-485..

    Why take all the approved application and create another backlog..although Congress passes law ..its upto USCIS to intrepret it so that it makes sense to them and then apply it...

    It will create unneccesary Choas if people again have to start from scratch after waiting for 5-8 years...and with the back loga they have right now..you can safely assume that this it not affact majority of us

    Is this true? Can we include the interest paid in India's property loan in our tax returns 1040 in US? I was thinking it was not possible? Can someone confirm this..

    Not sure about which bank would be good but whichever bank you choose make sure that they give you a statement of how much interest you paid over the year. Most people don't realize that you can deduct interest paid for a home loan in India is tax deductible in the US. Just FYI.

    We applied on 8th Aug for AP; Got receipts with receipt date of 13th Sep from NSC. I got my AP approved on 14th Nov. but we are waiting on My wife's AP since. Haven't received it.

    So we are planning to get our H1/H4 stamped and travel without AP. My Lawyer thinks it shouldn't be a problem

    There seems to be 2 different opions about the process after CIS has received hundreds of thousands of applications until Aug 17th.

    1. Once received, CIS cannot sort out the applications according to PD, so only RD is important.

    2. PD is still an important factor, so if CIS is stuck with tons of applications on their hand, they will prioritize them by PD, which means if you have PD Dec 2004 and RD Jul 25 2007, you will be approved earlier than someone with PD Mar 2005 and RD Jul 2 2007.

    Greg Siskind, an immigration lawyer known to most folks here for his blog, says in his new FAQs that CIS should work on by PD.

    I think that's a fair thing, but I'm wondering how they would be able to sort out the flood of applications. Any idea?

    Unfortunately, we will never know the daily or weekly details. If you see three bills introduced in a year like you saw last year, then it is the result of lobbying effort. IV core has periodic meetings with lobbying firm and all your money goes into that. Plus several trips to DC by IV leadership, to represent YOU and ME.

    Are you part of core?

    Can i take that core will not even give out information on what efforts it is lobbying currently?

    I wonder how i will convince some of my friends to contribute to an effort which is not shared?:confused:

    I am happy for following things in life:

    1) I still have a job, or atleast pay.
    2) I have an EAD, those in PERM, 140, do not have that option.
    3) I am better placed than those seeking immigration as brothers and sisters of US citizens :-d or as married children of US citizens.

    I am not happy about:

    1) Don't have the plastic that says, I can stay on even if I don't have a job.
    2) Those from other countries getting "lottery" visa instead of hard work.

    Who said "hard work" pays off? It just takes LUCK in life for things to fall in place. From tomorrow, I am just going to buy lottery and do NO work.

    I dont think Luck is all that is needed in life. Getting a perspective on things around is the key. Understand this fact. Recession happens once every 6 years on average. Every recession seems like a depression during the times. Believe me, we felt that the tech meltdown of 2001 was the end of the world for all those high flying dreams. Today people say that the 2001 recession was a mil one. Yeah, tell that to the people on H1 visas wo lost their jobs and had to leave the country. The same scenario seems to be the case now. Just hang in there and dont go by these bogus media headlines that scream that one would have to wait atleast for 10 years for a GC. They were the same then too. Do what you do well with this perspective in mind and you should be ok.
