The Cap seem to be moving slowly in the past few months, but something is different with the release of the new count this week.
As of September 18, 2009, approximately 46,000 H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) cap-subject petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. It seems that some employers are hiring again and willing to file for H1B visas for specialty workers. This is a good sign, but this also means that visas may run out sooner than expected.
USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn.

Each application is seperate as each one is for a seperate future job. Filing a new EB2 labor will have no effect on your existing EB3 app.
You should not be getting RFE on new app due to old app being pending.

I have applied for my I-485 ( PD: jan 2007- EB2, India).
I want to leave MS and join a different company now ...Question is do you know if MS withdraws I-140 ????
does anybody know what is the official policy ?? Please respond to me with a PM if you think it is inappropriate to discuss publicly...

I have applied for AOS/EAD/AP. I am moving to a new address soon. Will the recipt and EAD/AP be sent to me Old address? I am worried that they may get lost.

Today , an officer from Homeland Security visited my office.
The guy showed his Identity Card and was looking for me and the my boss (who signed the Visa Papers). He took me privately in a conference room and asked me questions like my pay, my duties, who paid for H-1 renewal etc.
Then he went to our HR dept and asked a few questions regarding my employment history. He asked me if you are treated well in this company. ( Note: Mine is not a consultant company) Anyways the guy was very polite and he told me its just a formality from homeland security
also he took picture of my desk
On searching more on this I came across this site

Sure doesn't sound right. I'd suggest some controlled tests, using a gray card (or even a white card). Check the actual color with your favorite editor (Photoshop, etc). It might be your monitor calibration, too.
At this point you don't really know if white balance WAS correct and, after the update, it's wrong - or vice versa.
