My old friend Bernie Wolfsdorf is at this moment addressing the American Immigration Lawyers Association where he takes the helm as the 10,000+ organization's newest president. Bernie came here 30 years ago from South Africa and has built up a great immigration practice in Southern California. He leads the organization at a critical time. There are new crises everyday and a system that is broken at nearly every level. Fortunately, the pro-immigrant community has a great leader in Bernie who has been a tireless advocate for decades. Hi guys,
I know lobbying takes money, but i am not sure how much we need.
I see lots of emails about funding going around, but i am not getting any idea of how much exactly is needed.
Can the admins post a funding drive! and set some target - say, "100000$ funding drive". If we have a target, we can pitch in money and try to meet that. If we fall short, we know how much we need more, so that people can make extra contributions.
Once again, this is just my random thoughts.

You can transfer your H1 to another company and you will get extension of same validity period (check your I94 Expriry period).
You can retain the priority date of your labour when you file I-140 in the new company.
By the way, why dont you start your I485 process now in the current company? You have lived with them for so long, 6 more months after applying I485, may not be a matter I think.....

Hi everyone:
I'm new at this forum and am hoping someone would be able to shed some light on my dilemma. My labor certification is currently under supervised recruitment. I checked the America's Job Bank website and found my ad, but the job description in it contained only the part according to O*Net occupation description. The form ETA-750 had some additional job requirements posted by the employer, which were omitted in the AJB ad. I'm afraid with the current ad at AJB they'll get tons of applications.
Can someone advice what shall I do?

Hi,
My wife has H1 visa approved under Consular Processing from Company A, so she is still under H4. She got another offer from Company B so we applied for another H1B before H1B quota expired. It is under process.
1 ) we applied for COS from H4 to H1 By Company A by premium processing.
2 ) Company B H1B from H4 is also under process.
Does the order of outcome from either petetions affect another petetion. For example if companie A petetion is approved and then afterwards company B petetion is rejected. will she be in H1 status.

During my last H1 transfer in 2008,LCA was filed for 60k per anum.LCA was filed in as work location Lanham,MD
Last Year ,my payroll ran for 90k per annum.
This year , my pay stub is running for 60k per annum. Still my Labor is for 60k only.
Will this be a problem when I am applying for Labor and at I140 stage in GC process?
Now If I am applying for H1b Extension,because of this drastic difference of 30k per anum,
will this be a problem.

I've written a number of times that we need to think about pursuing piecemeal immigration reform and give up on the notion of a comprehensive solution. The reason for this is simple math - you need Republican votes in the Senate to make it happen and the Republican Party has moved so far in to the Tea Party camp that it can't even muster a single pro-immigration voice. USCIS used to have a lot of difficulty raising fees and would only get increases approved every few years. They now raise their fees frequently and have just announced their intentions to do so again. In the past, they blamed poor service on the lack of resources and promised - many times - that more money would translate in to better results. I once supported this view. But no longer. Dear All,
I have a question regarding the H1b visa quotas.
The USCIS website stated on April 20th that they are still accepting applications as the H1 quota of 65000+ 20000(Masters) was not full.
Does anyone have any information about the latest news in this regard?
Has the cap been met or are they still accepting applications?

My friend and his wife re-entered US on AP a couple of weeks ago....They were paroled into US till Apr 2009. Their APs are valid till Oct 2008. Now his wife needs to go back to her home country immediately for a while (not sure how long due to family emergency).... If she doesn't plan to return before her current AP expires, what are her options to re-enter. My friend is still on H1 status valid till 2010, no H1/H4 visa stamps.....If she intends to stay home longer, can she re-enter US on a H4 visa after getting it stamped...If she plans to return before her current AP expires, say in Sep 2008, is it safe to use AP because she will be out of the country for 5 months if she leaves now and we are not sure if someone can stay out of US for that long and re-enter on AP.....Any suggestions...His PD is April 2004 EB-3 India

When Senate Majority Leader Harry Reid picked up his ball and went home after his staged all-night session last week, he saved from possible embarrassment one of the least regular members of his Democratic caucus: Sen. Ben Nelson of Nebraska. Reform Republican Tom Coburn had ready an amendment to the defense authorization bill removing Nelson's earmark funding a Nebraska-based company whose officials include Nelson's son. Such an effort became impossible when Reid pulled the bill.
That Reid's action had this effect was mere coincidence. He knew that Sen. Carl Levin's amendment to the defense bill mandating a troop withdrawal from Iraq would fall short of the 60 votes needed to cut off debate, and Reid planned from the start to pull the bill after the all-night session, designed to satisfy antiwar zealots, was completed. But Reid is also working behind the scenes with House Speaker Nancy Pelosi to undermine earmark transparency and prevent open debate on spending proposals such as Nelson's.
These antics fit the continuing decline of the Senate, including an unwritten rules change requiring 60 votes to pass any meaningful bill. When I arrived on Capitol Hill 50 years ago, Majority Leader Lyndon Johnson (like Reid today) had a slim Democratic majority and faced a Republican president, but he was not burdened with the 60-vote rule. While Johnson did use chicanery, Reid resorts to brute force that shatters the Senate's facade of civilized discourse. Reid is plotting to strip anti-earmark transparency from the final version of ethics legislation passed by the Senate and House, with tacit support from Republican senators and the GOP leadership.
At stake is the fate of Coburn's "Reid amendment," previously passed by the Senate and so called because it would bar earmarks benefiting a senator's family members such as Reid's four lobbyist sons and son-in-law. Nelson's current $7.5 million earmark for software helps 21st Century Systems Inc. (21CSI), which employs the senator's son, Patrick Nelson, as its marketing director. The company gets 80 percent of its funds from federal grants, mostly through earmarks. With nine offices scattered among states represented by appropriators in Congress, the company has in recent years spent $1.1 million to lobby Congress and $160,000 in congressional campaign contributions. "As of April," the Omaha World-Herald reported, "only one piece of [the company's] software has been used -- to help guard a single Marine camp in Iraq -- and it was no longer in use."
In requesting the 21CSI earmark, Nelson did not disclose his son's employment. "There's no requirement that he disclose that," a Nelson spokesman told this column. "But frankly, in this case, we didn't disclose it because it's so public." An April 24 letter from Levin giving senators instructions on how to request an earmark made no mention of the "Reid amendment" that had been passed by the Senate three months earlier but that required only certification that no senator's spouse would benefit from an earmark. Inclusion of Nelson's son, however, would be required if the ethics bill provision passes.

Last week, he cut off an attempt by Sen. Arlen Specter, the veteran moderate Republican, to respond to him with an abruptness that I had not witnessed in a half-century of Senate watching. When Specter finally got the floor, he declared: "Nothing is done here until the majority leader decides to exercise his power to keep the Senate in all night on a meaningless, insulting session. . . . Last night's performance made us the laughingstock of the world." It may get worse if plans to eviscerate ethics legislation are pursued.

I have a PD of September 2007 in the EB-2 category. I am currently on an H1B 3 year extension(after 6 years) on basis of an approved I-140.I am a physician and would like to pursue a fellowship given that it is unclear how many years I will have to wait to get a green card. Can I extend the H1B (change employer),given that I got the 3 year extension of the H1b on the basis of an approved I-140? What are the consequences for the H1B visa (employer change).I know I may have to start my green card process all over again.Thank you.

Now a days VFS is not releasing appointment dates more than 2 - 2.5 weeks in advance. I am not aware of any specific time of the day when these become available.

Once you get married and get your License your spouse can file for I-130, I485 concurrently. You can file for EAD and Advance parole also along with this you need affidavit of support I-824
