I have heard it is possible to change employer on 7th year of H1-B, though not immediately. The new employer should file LCA more than 365 days before the H1-B expires. Next time when renewing H1-B it can be renewed with new employer.

Please verify the above thoroughly before taking any step.

Do you know, how one could apply for a Visitor Visa without a Sponsorer in the US ?

What documents do they need to furnish ?

As I understand there are a lot of ppl who come to the US who do not have kids/relatives here, what do they have to show if they are just coming to the US for a Visit not work related ?

You should be able to contiue your GC without interruption even if you did not work for the sponsoring employer. but just make sure you are employed with the sponsoring employer before filing for I-485.

You may need a new H1 to go back to the previous employer. But GC should not be affected.

In theory, you don't have to be in the US for any part of the permanent residence (PR)process. A company could do a labor cert and I-140 for you, and then you could complete the PR by interview at a consulate, and only then start working for the US employer. In practice, of course, that never happens. However, it is possible so that you can safely go to India.

Hi,

I had applied for 485 without EAD/AP since we wanted to file it on July 2nd. Still waiting for the receipt. Recently our lawyer sent the EAD/AP application based on the new rule, with just the FEDEX receipt confirmation of the 485 application. However, he sent the application to CA Service Center stating that based on the new direct filing rule, it can be sent to the local Service Center.

Is that right? Anyone with similar experience or insights. As far as I know it has to be sent to the same service center where we applied for 485 (NSC).

Any document or FAQ from USCIS that can clarify this issue?

I am currently in Dallas. For applying a duplicate passport, it is OK if i Mail my application through USPS express mail which provides acknowledment . Can anybody please tell me if there is any problem with this?

C. List your present and past membership in or affilation with every organization , association, fund....

I am currently a member of the below listed service oriented/not for profit organizations.

Do I need to tell about them?
