Hello,
Any has a contact of a good immigration lawyer in San Jose/Bay Area - CA?
We are looking at starting a business and would like to consult an immigration lawyer for the type of business ownerships. I have the EAD. If anybody is in similar position, please share your experiences.

The big news is that the masters cap was hit as of December 24th. I had been predicting since last summer that this 20,000 quota would be hit in the last week of the year and the pace of usage stayed extremely consistent. The general quota has 7,700 visas of 65,000 remaining as of December 31st and the rolling four week average is now running at just over 1500. What kind of an audio file are you going to be playing? Will it be something like a sound loop?
The reason I ask is that, on the Windows Phone, you can use the XNA Libraries instead of Silverlight for some media playback scenarios :)

One of my friends has her concern:
Her mother visited her last year. Her mother went to hospital (Feb, 2007) for emergency and got debt for $4300. My friend was the contact person of her mother in US and signed a form (I am not sure what form) for the bill. So far my friend did not have money to pay for the debt. The hospital transfer the debt to a debt company. The debt company has put her mother's name in credit record.
My friend need go outside US for her first H1-b visa interview. She is concerning if she will have problem to get her h1-b visa because of the debt? Any chance to get check such as name check,....

no, you don't have to stick with lawyer for everything.
I have friends who filed 485 through lawyers and have been filing AP and EADs on their own.

Hi,
My employers are considering transfering me to another group company (different name) during the next 1-2 months. My job profile will remain unchanged, but the employer name/address (on paychecks, etc) will be different after the transfer. My I-140 is still pending (filed in Aug 2007 together with I-485 at NSC under EB-3).
I'd greatly appreciate anyone's advice on the following:
a) If I transfer before my I-140 is approved, do I need to notify USCIS in writing? If so, does any specific paperwork need to be filled out? My employers have assured me they will continue to support my I-140/485 under the original company name, for as long as required.
b) If I transfer after approval of I-140 (fingers crossed!), do I need to notify USCIS? Again, is any specific paperwork necessary?

My friend approved PERM in EB2 have qualification 3 year B.SC + 1 Year B.Ed + 2 year MSc. total 6 years of college, filed I-140 and was denied because of education. The labor is for Masters with 0-1 year experience. But they want 4 year degree prior to masters, citing EDGE database. Now the appeal is with AAO.
My question:
1. Do he can apply with the same labor for EB3 ?. What is the chance with two I-140 with same labor ?
( He filed I-140 for EB2 with that labor before 6 months of PERM certification. The PERM certified on April 2009 )
2. Or he need to do a fresh PERM with EB3 as a backup till the AAO verdict ? (takes 22 months)

I am a July 2007 filer. I filed for I-485 using the old fee structure and also applied for AP in July 2007. My AP got approved in 07 but expired so I had to apply for AP in Aug 2008. So I filed in Aug 2008 and paid $305 for AP fee. Now it's to reapply for AP as it expires soon; however I was under the impression that I wouldn't have to pay for AP fee again. I sent the forms to USCIS but the AP package got returned as they claim i don't qualify for free fling.
Anyone else in this position (I am assuming a lot of you guys are... please share your experience). Do we have to pay every year for AP?
