For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications. My wife's EB2 I-140 is pending. Now we find that the job description on the labor certificate does not qualify for EB2. We are going to file a new application for Eb3. But the original LC has been submitted in the last EB2 application. Please advise what we should do. Thanks!!!

Hi ,
1.My wife works for part ime H1b. She has her H1B till Aug 2011. She would Like to apply for her GC. Can she apply for labor certification with part time job? She can get a full time job after she gets in to adjustment of status. She doesn't want full time job now as our kids are still small.

2.I have a fulltime H1B and Approved I-140 EB2. PD sept 2007, waiting for retrogression to file 485!!!! god know when that will happen.Can I apply for EB1 while my EB2 pending?
I have good credential to meet EB1.

I applied for EAD renewal to Nebraska center on Dec 12th.
So far I didn't received the receipt and also my check didn't get cashed.
Did anybody encounter similar situation. If so please let me know what you have done.

I am working on Windows 7 based application development in Silverlight. I have not been able to find a way to play a an audio file in windows 7 phone. I have been googling it since past few days but i could not get any solution of that. There is a class in C# with name SoundPlayer but i guess its not available in Windows 7 Phone.

The AC21 determination of whether a new job is in "the same or similar occupation" is made based on a comparison of the new job duties and those set forth on the original labor certification application. Job titles are not controlling. So, you need to have a copy of your original LC application and then compare the job description it contains to the duties of the new position.

My 485 is under processesing with a priority date of March 2006.

I was browsing through the instructions to e-file my I-131 (Travel document) and found this interesting point and was a little confused.

This is from USCIS website

You are not eligible to electronically file this form if:

You have a pending I-485, Application to Register Permanent Residence Status or Adjust Status currently at a USCIS office and you are eligible to file the I-131 for no additional fee.

Does this mean we can no longer file for I-131 online...? I did this last year and didnot have any issue's. Any thoughts/opinions/experiences are highly appreciated. Thanks

Please help me, married a us citizen right after 3 months I have my green card in 08 we got into a fight and she divorced me 2 months later and finally decreee june 2008. we are back together and live in the same house hold and in feb 2010 when my green card expire and I need to file to remove the condition, I dont know what I or we need to do?? is this the better way is for us go down to court house and get married again? we still have banking account together and bill together>
Please let me know what is the best for my situation.

I140 approved on Sep 2008
I 485 in process - submitted RFE on Sep 10th

Right now i m on H1B. I recently got married and my husband is on H1B he didnt start his GC process yet. At this stage can i add him on my green card. If so pls explain me the process ...

You can file your spouses' 485 when your PD is current. Follow the visa bulletin every month. Please fill out your IV profile.

My name is mistakenly typed in the form I-129 submitted to USCIS. In that form only, in all other forms(including i-129 supplements) it has typed correctly. So, it's reflecting in I-797 as venuKalangi(last/family Name), Venu((first Name). "venu" is repeated. My actual Name is Venu(first name),Kalangi(last/family name).

My petition is filed on apr27th'2010 and is in initial review now. Can you pls guide me what need to be done now. I'm a new applicant and my travel date is in last week of october. I heard that I need to apply for amendment, if so, by which form it need to be done and how much time it may take for correction or Can I go for stamping without amendment, is it causes any problem?

Hi,

My brother is coming to USA on L1 visa.
His wife has a valid H1-B stamped. However, her employer cannot send her to US for the next 6-7 months.

Can she come to US on L2 and then transfer her H1-B if whe finds a job here in US? Or will her H1-B get immidiately cancelled as soon as she enters US on L2?
