On June 25, President Obama met with a bipartisan group of 30 key legislators beginning a dialogue that he hopes will lead to comprehensive immigration reform in 2009 or early in 2010. Among the topics discussed were border security, family reunification and reform of the outdated quota system. Following the meeting, the President stated, but what Im encouraged by is that after all the overheated rhetoric and the occasional demagoguery on all sides around this issue, weve got a responsible set of leaders sitting around the table who want to actively get something done and not put it off until...

Hi,
I have I-140 approved(ABC company) and have 5 months left in my first 6 year cycle. I was laid off from the job. A New employer XYZ applied for my H1B extension based on I-140 approval and got approved for 3 years. But I was unable to join
XYZ due to family situation and moved back to India.
Questions:
1. Can a new employer apply for H1B extension based on my I-140 approval even though I am not in USA.? My I-140 has not been revoked or cancelled.
or
2.Can I claim the remaining time on my H1B approval(based on I-140) with company XYZ ?I have copy of the H1B approval but not sure if it has been revoked.
Please advice.
Thank you in advance.

yes it is true
Is this True --??
It seems USCIS has set a quota of X number of 485 applications till SEP 07.Once that quota reaches, dates will retrogress.
After that 485s will be processed by PD and not by RD.

Hi All,
One of my friend has been working for a desi company for 6 months and now is moving to another company.
In the desi company offer letter there is no information regarding leave encashment and it says that he is eligible for one day leave per month.
There is no statement regarding leave encashment policy in the offer letter
So if he resigns now will he get any leave encashment or is there any virginia state laws governing the leave encashment
Thank You
Abhi

USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. The idea is that employers would need to register to claim an H-1B cap number first and then if they are selected, they then would prepare and file the case. Right now, employers have to go to all the trouble of preparing a case that may be rejected simply because the visa allocation is filled. I think...

Did any body renew thier EAD's recently?..instruction on page 12 says that the Filing fee of $340 is waived coe category C9...is that true..
Only for people who paid the new I-485 fee effective July 31st, 2007. Lot of the July 2007 VB filers (even in August 2007) paid the old fee, and have to pay the $340.

Hi,
Need some help here for my friend.
He is an employee of company A and his first 3 yrs H1 is ended say Sep
25, 2009. But he was already got a new H1 approved 1 month back from
company B and that company had assured him to take him on board from
Sep 26, 2009. So he and his wife had both approved H1/H4 from Company
B. Now last minute the company B backed off from their agreement.
So he went back to his company A and asked for H1 extension on Sept
24, 2009 and for which they filed papers. But they didn't file papers
for his wife's H4. Can she be on company B's approved H4? if not how
many days she has to file for H4 linked to company A.
Thanks

Hi all, I have a question regarding my current situation. I'm currently working for this non-profit organization under my OPT that is good until the end of Oct of this year. My question is basically whether or not I can ask my employer (already agreed) to petition for me for an H1-b visa? Can I still apply right now before my OPT expires or would it be better to apply next year on the first day of April? If I can get an approval for my H1-b would it be good to get a TN in the meantime and later have my employer petition me for an h1-B then?
Any suggestions would be greatly appreciated as I don't want to waste the opportunity to apply if I can get one at this time. I heard is better and easier to apply for one while under OPT than TN to H1-B but I'm not sure or rather confused about this!
Thanks in advance.

A year ago, Rahm Emmanuel tried to convince President Obama not to pursue health care legislation. It would be too divisive. Now he's making the same case on immigration and it is upsetting many pro-immigration Democrats. The problem is that President Obama was elected as an agent for change, not simply to be a status quo President who would mind the store until someone bolder comes along. I've been impressed that President Obama has indicated he would be content to be a one term President if that meant he could leave with major accomplishments under his belt. Let's hope his...

Hi,
My employer filed for I-140 and I-485 last year July. My I-140 got approved with a labor converted from RIR.
I want to know the priority date in the approved I-140. But the employer is not giving me copy of I-140. I called USCIS and they say they cannot give the information to be.
How do i get my priority date now?
I have I-140 and I-485 receipt numbers.
Can you find it thru I-485 receipt number?
Thanks for the answers.

The visa bulletin says "Effective Monday July 2, 2007 there will be no further authorizations inresponse to requests for Employment-based preference cases. All numbers available to these categories under the FY-2007 annual numerical limitation"
But doesnt that mean that no I485 authorizations will happen but filing can still be done and EAD received as de facto?
Please ask your respective lawyers to clarify this with USCICS/DOS.
